The contracting authority needs to enter into service concession agreements to ensure the municipality users user controlled personal assistance (BPA). The BPA services shall be able to include both existing users in the municipality, as well as any new users who are added during the contract period. There is a political decision on free user choice in the municipality. Free choice of users means that users who have BPA individual decisions from the municipality can freely choose between private tenderers who the municipality has a service concession agreement with or municipal operations (BPA services carried out by the municipality itself). The contracting authority needs to enter into agreement with private tenderers in order to ensure the free choice of users. The tenderers who sign a service concession contract shall be equal and the user in accordance with the free choice of user choice (and any change) supplier shall be chosen. The user ́s choice shall not be subject to any limitations other than that the choice must be made between tenderers who have a service concession contract with the municipality or public services. The user shall not have to justify his choice and the choice must not be reviewed. Once a user has chosen the preferred provider, the tenderer is obliged to provide the services. The tenderers who enter into service concession agreements with shall, after an order, be obliged to provide the services within the framework of the applicable laws and regulations, the municipality ́s individual decisions on BPA and the applicable contract(s).
