COLLABORATION AGREEMENT by and between Isavia and Blue Lagoon for a retail premises at KEF airport

A contracting entity may opt for direct procurement e.g. if only a certain supplier can implement the procurement for a technical reason, or for a reason related to protecting an exclusive right. A further condition is that there are no reasonable alternatives or substitute solutions, and that the absence of competition is not due to an artificial narrowing of the terms and conditions of the procurement. Isavia has recognized the Blue Lagoon brand (shop) as a domestic, world-renowned brand to strengthen the supply of traveller services at Keflavik Airport with premium products that combine the power of local nature and science, creating formulas designed to optimize skin health. Isavia has received a confirmation from Blue Lagoon that the Blue Lagoon Shops are owned by and operated with exclusive rights, i.e. only The Blue Lagoon can bring a Blue Lagoon store to Keflavik Airport. Isavia’s wish is to strengthen the service supply specifically by providing retail brands and products with domestic traits that are focused on Icelandic brands, fashion and design and in that way distinct itself in the competition among the international airports’ services and offerings. On these grounds and following a preliminary market consultation that yielded no comments from other market participants, Isavia has entered into a concession agreement directly with The Blue Lagoon as a strong and renowned Icelandic brand. Isavia considers that there are no reasonable alternatives or substitute solutions, and that the absence of competition is not due to an artificial narrowing of the terms and conditions of the procurement.
