Hamar municipality has signed a contract with Aktiv and Ung Innlandet AS without publishing a competition for this procurement. Justification for the procurement without a prior notice. The background is that the terms in the Procurement Regulations (FOA) § 30-4 are deemed fulfilled. In this case, it is not possible to hold a proper competition without giving out confidential and sensitive information about the service recipient's health status and care needs. This also applies to any intention notice, which cannot be published without divulging information subject to statutory confidentiality. Furthermore, Hamar municipality refers to the Public Procurement Regulations § 13-3, which allows for a direct procurement when there are coercive reasons that make it impossible to comply with ordinary deadlines. There is an acute and unforeseen need for health and care services for a service recipient with serious mental illness. The service recipient needs comprehensive and immediate screening measures, which cannot be taken care of within the existing service offer or in a shared housing. Due to the acute health situation and the particular requirements for screening and continuity in follow-up, it is considered strictly necessary to enter into a contract directly with a tenderer with whom the municipality has good experience and who has documented competence and capacity to safeguard the need. The procurement is, thus, carried out without a competition in accordance with the exclusion provisions in PPR § 30-4 and § 13-3 letter e, and with the user's best interests as the general consideration.
