Sykkylven municipality has awarded the assignment of winter maintenance to Hole Maskin (org. no. 933180832). The work consists of winter maintenance of 5 areas in Sykkylven municipality. The contract award was made after an open tender contest published on Doffin, with reference numbers 2021-391840. The estimated value of this agreement is up to NOK 20 million. Hole maskin AS bankruptcy on 14.03.2024. Two years of the contract period remains. Sykkylven municipality would like, with this intention notice, on Doffin to inform the tenderer that we use Hole Anlegg AS org. no. 931776223 to the remaining period. The Procurement Regulations § 28-1 (1) e) states that the contracting authority can make changes in a contract where the tenderer can implement a new competition if the change applies to a change of tenderer, by the new tenderer completely or partially entering into the existing tenderer ́s legal right and obligations as a result of restructuring (for example, by bankruptcy), if1. the new tenderer fulfils the original qualification requirements, 2. other changes in the contract and 3 will not be made. The change of tenderer does not occur to work around the regulationsHole Anlegg AS enters into the contract due to bankruptcy at Hole Maskiner AS. A change of contract party occurs because it is formally a new company. Sykkylven municipality has assessed that Hole Anlegg AS has equivalent qualifications as former Hole Maskin AS.
